Welcome
OutCycling offers group bicycling rides and related activities. These Terms apply when you participate in any Club Activity, visit our website, or sign up for communications.
Quick summary
Cycling has real risks. You are responsible for your health, your bike, and your choices. By joining, you accept those risks and agree not to hold OutCycling responsible for injuries, losses, or damages, except where the law does not allow a waiver.
1.0 Ride Waiver & Release
1.1 Acknowledgment of risk
Bicycling can cause serious injury or death. Risks include, for example: traffic, road hazards, weather, collisions, equipment failure, and the actions of other riders or drivers. You voluntarily choose to participate and accept these risks.
1.2 Eligibility and personal responsibility
By participating, you confirm that:
You are at least 18 years old, or a parent/guardian has agreed in writing to these Terms for a minor
You are physically able to ride and will not participate if you feel unsafe or unwell
You will ride in control, follow ride leader instructions, and obey all traffic laws
You will use a bicycle in safe working condition and wear appropriate safety gear (helmet strongly recommended; required when stated for a specific ride)
1.3 Safety and conduct rules
To protect the group, you agree to:
Follow posted ride guidelines and the ride leader’s directions
Ride predictably, communicate hazards, and respect other road users
Not ride under the influence of alcohol, cannabis, or any impairing substance
Treat other participants with respect. Harassment, threats, or unsafe riding may result in removal.
1.4 Release of liability
To the fullest extent permitted by law, you release and agree not to sue OutCycling and its directors, officers, employees, volunteers, ride leaders, sponsors, and agents (“Released Parties”) for any claim arising from your participation in Club Activities, including claims related to negligence.
This release includes claims for personal injury, death, property damage, or other losses connected to an Activity.
1.5 Indemnity
If your actions cause harm, injury, or damage to another person or property, or lead to a claim against the Released Parties, you agree to defend, indemnify, and hold the Released Parties harmless to the fullest extent permitted by law.
1.6 Medical consent and emergency care
If you are injured or become ill during an Activity, you authorize OutCycling and/or emergency personnel to provide or obtain medical care for you. You are responsible for any medical costs.
1.7 Media release (photos/video)
We may take photos or video during Activities for community, educational, or promotional purposes. By participating, you grant OutCycling permission to use your likeness in this media without compensation. If a specific event offers an opt-out process, we will honor it when feasible.
1.8 Removal, cancellation, and disqualification
OutCycling may:
Modify routes, start times, or rules for safety or operational reasons
Cancel Activities due to weather, safety concerns, or other conditions
Remove any participant at any time for unsafe behavior or rule violations
1.9 Website Terms - Use of the site
You agree not to misuse the site (e.g., hacking, scraping, spam, or unlawful activity). Content on the site is owned by OutCycling or used with permission and may not be copied or republished without consent. We may link to third-party sites. Their practices are governed by their own policies.
1.10 If any part is unenforceable
If a court finds any portion of this waiver unenforceable, the remaining sections still apply to the fullest extent permitted by law.
2.0 Privacy Policy
2.1 Information we collect
We may collect:
Contact details (name, email, phone) when you sign up or contact us
Ride participation details (event sign-ups, waivers, emergency contact if provided)
Basic website analytics (device/browser info, pages viewed, approximate location)
Payment information when you donate or purchase (typically handled by a payment provider; we receive confirmation, not your full card details)
2.2 How we use information
We use information to:
Run Activities and communicate ride details
Respond to inquiries
Improve programs and website performance
Manage donations, memberships, or registrations
Comply with legal obligations and prevent fraud/abuse
2.3 Sharing information
We do not sell your personal information. We may share limited data with:
Service providers who help us operate (email, forms, payments, analytics)
Authorities if required by law or to protect safety and rights
Event partners only when clearly disclosed for a specific event (and only what’s needed)
2.4 Data retention
We keep information only as long as necessary for the purposes above, and longer if required for legal, safety, or recordkeeping reasons.

3.0 Text Messaging Terms (SMS/MMS)
3.1 Consent
If you opt in to receive texts from OutCycling, you consent to receive informational and/or promotional messages related to Club Activities. Consent is not a condition of purchase or donation.
3.2 Message frequency and costs
Message frequency varies. Standard message and data rates may apply.
3.3 Opt out and help
To stop: reply STOP (or follow the opt-out instructions in any message)

3.4 Privacy
Texts are covered by this Privacy Policy. We use messaging providers to deliver messages.
3.5 Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute must be brought in the appropriate courts located in New York, New York, unless applicable law requires otherwise.
3.6 Changes
We may update these Terms from time to time by posting the revised version on our site with a new “Last updated” date.
